Terms & Conditions (AGB) for kumonook
1. Scope
(1) These Terms & Conditions apply to all orders placed through the online shop “kumonook”, operated by:

(referred to as “we”, “us” or “the seller”).
(2) Any differing or supplementary terms of the customer will not become part of the contract unless we expressly agree to them in writing.

3. Orders & Contract Formation
(1) The products displayed in the online shop are not a legally binding offer, but an invitation to place an order.
(2) By placing products in your cart and clicking the “Buy now” / “Checkout” button, you submit a binding offer to purchase the items in your cart.
(3) The automatic order confirmation you receive by email directly after placing the order only confirms that we have received your order. It is not yet an acceptance of your offer.
(4) The contract is only concluded when we either explicitly confirm your order by email or dispatch the goods to you. The earlier event is decisive.
(5) The contractual language is generally English. For customers based in Germany, we may additionally communicate in German where helpful.
4. Prices, Shipping Costs & Customs
(1) The prices shown in the online shop at the time of the order apply. All prices are final prices in Euro. Whether VAT is shown depends on our current tax situation and is visible in the checkout and on the invoice where applicable.
(2) Additional shipping costs may apply. These will be shown separately during the ordering process.
(3) For deliveries outside the European Union, additional costs may apply (e.g. customs duties, import taxes, handling fees) charged by local authorities or carriers. These costs are your responsibility.
5. Payment & Due Date
(1) Payment is made via the payment methods offered in the online shop (e.g. credit card, PayPal, Shopify Payments or other providers).
(2) Unless stated otherwise for a specific payment method, the purchase price is due immediately when the contract is concluded.
(3) If payments fail or chargebacks occur and you are responsible for this, we may pass on any resulting fees to you.
6. Delivery & Shipping
(1) Delivery is made to the shipping address you provide during checkout.
(2) Estimated delivery times are shown in the online shop or during checkout. These are non-binding estimates unless we explicitly confirm a fixed delivery date.
(3) If not all ordered items are in stock, we may make partial deliveries where this is reasonable for you. You will not incur additional shipping costs for such partial deliveries.
(4) If delivery fails or is returned due to incorrect or incomplete address information, additional costs may arise which you may have to bear if you are responsible for the incorrect details.
7. Retention of Title
(1) The goods remain our property until they have been paid for in full.
(2) For business customers, we retain ownership of the goods until all claims from the ongoing business relationship have been settled.
8. Right of Withdrawal for Consumers (EU/EEA)
(1) If you are a consumer and your usual place of residence is in the European Union or European Economic Area, you generally have a statutory right of withdrawal of 14 days for distance contracts.
(2) Details about your right of withdrawal, the withdrawal period and how to exercise it are set out in our separate Withdrawal / Refund & Return Policy.
(3) The right of withdrawal does not apply in particular to contracts listed in Article 16 of Directive 2011/83/EU and § 312g (2) BGB (e.g. custom-made products); see section 9.
9. Custom-made & Personalised Products
(1) Some of our products are made according to the measurements or individual specifications you provide (for example PC case stickers cut to the exact size of your glass panel).
(2) For such custom-made or clearly personalised products, the statutory right of withdrawal does not apply, in line with § 312g (2) no. 1 BGB, if the goods are produced based on your specifications and clearly tailored to your personal needs. We will point this out explicitly on the relevant product pages.
(3) Please ensure that your measurements and other information are accurate and complete. We cannot accept liability for issues caused by incorrect customer information.
10. Warranty (Statutory Liability for Defects)
(1) Statutory warranty rights apply.
(2) For consumers, the statutory warranty period is two years from the date of delivery.
(3) If you notice obvious transport damage, we kindly ask you—where reasonably possible—to report this immediately to the delivery carrier and to inform us as soon as possible. Failing to do so does not affect your statutory rights, but it helps us handle such cases more effectively.
(4) Damage caused by improper handling, incorrect application or modifications to the products (e.g. tearing, strong creasing, misalignment, or cutting errors when applying the sticker) usually does not constitute a defect in the legal sense. In such cases, there is no claim to a free replacement or refund.
11. Liability
(1) We are fully liable for claims based on damage to life, body or health caused by our intentional or negligent breach of duty, or that of our legal representatives or vicarious agents.
(2) We are also fully liable for damages caused intentionally or by gross negligence.
(3) In cases of simple negligence, we are only liable for damage resulting from the breach of a material contractual obligation (cardinal duty). In this case, our liability is limited to the foreseeable damage typical for this type of contract. Material contractual obligations are those which must be fulfilled to enable proper performance of the contract and on which you may regularly rely.
(4) The above limitations also apply in favour of our legal representatives and vicarious agents.
(5) Liability under mandatory statutory provisions, such as the German Product Liability Act, remains unaffected.
12. Copyright & Use of Designs
(1) All designs, illustrations, motifs and product layouts offered in this shop are protected by copyright and/or other intellectual property rights. All rights remain with us and/or the respective rights holders.
(2) By purchasing a product, you acquire no rights to reproduce, digitise, resell, modify or otherwise commercially use our designs. You only receive a simple right to use the physical product for private purposes.
(3) Any commercial use of our designs, for example printing them on your own merchandise or reselling the artwork, is not permitted without our prior written consent.
13. Applicable Law & Jurisdiction
(1) These Terms and all contracts between you and us are subject to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers whose habitual residence is in the EU, the mandatory consumer protection laws of their country of residence remain applicable in addition to German law.
(2) If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contracts between you and us is our business location in Garbsen, Germany.
14. Online Dispute Resolution
(1) The European Commission provides a platform for online dispute resolution (ODR), which you can find at:

(2) We are neither obligated nor generally willing to participate in dispute resolution proceedings before a consumer arbitration board. Nevertheless, we always aim to resolve any issues directly and amicably with you.
15. Changes to these Terms
(1) We may amend these Terms & Conditions if there is a valid reason to do so (for example due to changes in the law, adjustments to our services or technical changes) and if the changes are reasonable for you.
(2) For orders that have already been placed, the version of the Terms & Conditions that was valid at the time of your order will continue to apply.
